ISLAMABAD: A three-member special bench has suspended the presidential orders of elevating Justice Khawaja Sharif Ahmed in Supreme Court of Pakistan and appointing Justice Saqib Nisar as acting Chief Justice of Lahore High Court.
The bench – headed by Justice Mian Shakirullah Jan and comprised of Justice Raja Fayyaz Ahmed and Justice Jawad S. Khowaja – declared the elevation of Chief Justice LHC Justice Khawaja Sharif as judge SCP against the Article 177 of the Constitution, observing that no consultation was made with Chief Justice of Pakistan on the said appointment.
The bench conducted the brief hearing of suo moto notice, taken by CJP Justice Chaudhry earlier today, in Court Room No. 1 of the Supreme Court of Pakistan and suspended the two notifications of elevation of Justice Ahmed and appointment of Justice Nisar in its interim order.
Justice Khawaja Sharif and Justice Saqib Nisar will continue serving their incumbent posts as chief justice Lahore High Court and judge LHC respectively, the bench declared. The bench has also ordered the concerned authorities not to administer oaths of the two judges for their new posts.
The five-member full bench constituted earlier today to hear the petitions regarding unnecessary delay in the appointment of judges in the courts will now take up the further hearing of the case on February 18, Justice Jan wrote in the short order.
Attorney General, Additional Secretary Law, registrar of Lahore High Court and other concerned officials have been summoned before the full bench on the said date.
Earlier, the three-member bench had ordered Attorney General of Pakistan Anwar Mansoor to appear before it immediately, however, it was informed that AG could not appear before the court as he was on a visit to Karachi.
The bench later studied the summary forwarded by the CJP to the Presidency for appointment of judges in SCP. It observed that the CJP was not consulted on the elevation of Justice Khawaja Sharif Ahmed in SCP as per Constitution and suspended his appointment in the apex court.
Chief Justice of Pakistan Justice Iftikhar Muhammad Chaudhry earlier today took suo moto notice of the presidential order and constituted the three-member bench to hear the case.
Earlier, a notification issued by the Law Ministry on Friday evening stated that the President has appointed Justice Nisar as acting chief justice of LHC following the elevation of his predecessor Justice Khawaja Sharif Ahmed as judge Supreme Court of Pakistan.
The appointments were conflicted with what was recommended by the CJP Justice Chaudhry, who in his summary to the Presidency had reportedly recommended elevating Justice Saqib Nisar to Supreme Court and retaining Justice Khawaja Sharif as CJ LHC.
The two judges have also refused to obey the orders and assuming their new offices, terming these illegal. They were quoted in the media as saying that they will only follow the orders of Chief Justice of Pakistan.

Politically speaking its not a bad move. I mean does it hurt PPP or zardari? Nope, almost noone likes him so he is gonna have 5% support down from 10%, when u that down u really dun care, case in point Bush. Same goes with PPP. But this could hurt SC and PML – N.
1 – By doing this, Zardari has successfully diverted the attention from non-compliance of NRO and swiss cases and has brought another issue to fore front. Meanwhile behind the scene they have critical talks going with India, where God knows wat else he will do, also it diverts from other governing issues. The most SC would do is declare that notification was illegal, Govt will say sorry and appoint the judges. Worst case scenario SC calls for contempt and guess wat, another eharing to decide Prez immunity.
2 – SC asked to appoint Justice Ramday as adhoc and ask Justice saqib appoint over justice shareef. Now it is debatable should senior justice should be elevated or not. Either way u look PPP and thier supporters and ppl who are weary of judicial activism (aasma jahangir) can make a case denting SC reputation. The goal of ppp led establishment has been consistent pick a fight dun matter u loose, every fight will cause some damage to SC and judiciary. Ali Ahmed kurd BTW is of opinion that senior judge should be elevated. We have already seen fractions in lawyers movement this will exacerbate it and in the end will sway some suipport away from SC. PPl will soon start asking why this court is always fighting. Remember its not who is right or wrong its perception.
3 – PML – N has now to come out openly they can stand and say we are for system but just make changes. The fact is this current crisis has made zardari presidency untenable. If they insist on keeping govt they will loose thier credibility too. Military would loathe to inetrvene any intervention will make PPP hero. This means PML – N has to pull trigger. The mid-term are only viable option, but simple calculation can show the most PML – N can hope is another coalition govt with all the problem x 10 in future while PPP would welcome that cuz the loss of electiosn will still keep them viable 2nd party in pak and none the headache of govt. This helps ppp to regroup and wait for another midterm.
So its not that crazy of a move. I dun think lot of ppl like this night court decisions of SC.

ARY: Zardari biggest threat to democracy: Nawaz
Pakistan Muslim League (N) chief Mian Nawaz Sharif has called President Asif Ali Zardari the biggest threat to democracy adding that no person can be allowed to dishonor the state institutions.
Nawaz was addressing a press conference on Sunday after a party meeting to discuss the standoff between the government and judiciary over appointment of the judges.
Nawaz expressed his concern over the government attitude towards state institutions adding that the yesterday’s incident has confronted the country with another spell of uncertainty.
He said the PML-N sees the government attitude with concern. Nawaz said it seems the government has not accepted free judiciary wholeheartedly.
He warned the government to ensure supremacy of democracy.
Nawaz said the rulers targeting judiciary to protect their corruption and childishly playing with the state institutions.

Geo: PM makes surprise visit to CJ hosted reception
Prime Minister Yusuf Raza Gilani Tuesday surprised the Chief Justice of Pakistan Justice Iftikhar Muhammad Chaudhry and other guests by appearing at the farewell reception hosted by the latter in honour of Justice (Retd.) Khalil-ur-Rehman Ramday.
Justice Iftikhar Muhammad Chaudhry welcomed the Prime Minister when the latter made his surprise entry into the reception space, Geo News’ correspondent Abdul Qayum Siddiqui reported. The CJP thanked the Premier for attending the dinner reception.
The Prime Minister spent some time with the CJP in a pleasant atmosphere where Chaudhry Aitzaz Ahsan was also present.
A large number of judges attended the reception.

no my problem is not that I go against everything. I criticized CJ when he met halbrooke. That was incredibly stupid and dumb. U know very well I dun agree with super judicial activism of court. But where i dun see anything wrong why should I blast. So cj meeting the PM, ideally yes ur right he shouldn’t be meeting specially since the issue in hand is subjudciious. Ideally Attny Gen should go to court and present the case. But if one meeting can resolve teh dead lock let it be.
2nd thing, we all talk abt democracy and rule of law, we must 1st start respecting offices of govt irregardless of who is occupying it i.e if they are duly elected. A respect must be shown to the office not to the person neccessarily.

Geo: PM, CJP meeting likely today
Chief Justice of Pakistan (CJP) Justice Iftikhar Mohammed Chaudhry will likely call on Prime Minister Syed Yusuf Raza Gilani here at 3pm today.
According to sources, in the first phase, out of 72, 42 judges will be appointed on vacant positions in in higher judiciary.
CJP Chaudhry may likely hold meeting with PM Gilani at Prime Minister House at 3pm today, knowledgeable sources expected.
Also, sources insisted that the notification, related to the appointment of two judges of Lahore High Court (LHC), will most probably be cancelled during the meeting.
The formal announcement regarding appointment of judges on different positions, lying vacant in Supreme Court, Sindh and Punjab high courts, may also be made, sources told media.

Geo: PM-CJ meeting ends crisis
The government has withdrawn the notification about the elevation of Chief Justice of Lahore High Court as Supreme Court judge.
On the recommendation of Chief Justice Iftikhar Muhammad Chaudhry, two permanent judges and one ad-hoc judge have been appointed to the Supreme Court.
Prime Minister Syed Yousuf Raza Gilani said the current tension between judiciary and government has now ended.
Earlier, Chief Justice Iftikhar Muhammad Chaudhry met Prime Minister Syed Yousuf Raza Gilani at the Prime Minister House.
The meeting continued for more than 2 hours, which was also attended by Supreme Court Registrar Dr Faqir Khokhar and Law Secretary Aqil Mirza.
Following the meeting, Prime Minister Gilani told media the government has decided to elevate Justice Saqib Nisar and Justice Asif Khosa to the Supreme Court of Pakistan, while Justice Khalil Ramday will be appointed as an ad-hoc judge in the apex court for a period of one year.
He said Justice Khawaja Sharif will continue to work as the Chief Justice of Lahore High Court.
Gilani said the decision has been taken in the best interest of nation, country, political forces and the democratic system.
Premier Gilani said: “We have held a meeting with the Chief Justice of Pakistan as part of a consultative process according to the Constitution.”
To a question, he said the decision has full backing of President Asif Ali Zardari. “I and President Zardari are part of one party,” he commented.
About appointment of judges in Lahore High Court and Singh High Court, he said that notification would be issued today, while all vacant slots would be filled.
